The parking pass (“Parking Pass”) is a revocable license for the Parking Pass holder (“you”) to enter an authorized parking facility once and occupy one parking space during a National Football League (“NFL”) game and related events (the “Game”). The Parking Pass may be revoked at any time and for any reason in the sole discretion of the Tampa Sports Authority (“TSA”) or Tampa Bay Buccaneers (“Buccaneers”), and each of their employees, officers, directors, owners, members, agents, or contractors (collectively the “Stadium Entities”).
The Parking Pass may be revoked at any time without refund for violation of Raymond James Stadium (“Stadium”) or parking rules, or breach of these Parking Pass Terms. If your license for admission to the Stadium (Ticket) is revoked, the Parking Pass is concurrently revoked.
If the Parking Pass is revoked for reasons other than (i) your disorderly conduct, (ii) your breach of Stadium or parking rules, including these Parking Pass Terms, or (iii) your non-use of Parking Pass because a Game is canceled and not replayed, THE SOLE AND EXCLUSIVE REMEDY is a refund of up to the amount the Stadium Entities received for the sale of the Parking Pass for the Game, as determined by the Stadium Entities. Once you present the Parking Pass and enter the parking facility, the Parking Pass is deemed used, and you will not be entitled to a refund if the Game is canceled or terminated early for any reason. The Stadium Entities’ liability for any breach of any these Parking Pass Terms shall not exceed the amount the Stadium Entities received for the sale of the Parking Pass for the Game, as determined by the Stadium Entities. IN NO EVENT SHALL THE STADIUM ENTITIES OR THE NFL BE LIABLE TO YOU OR ANYONE CLAIMING THROUGH YOU OR ON YOUR BEHALF FOR (1) ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING ANY AMOUNT PAID FOR THIS PARKING PASS TO A THIRD PARTY IN EXCESS OF THE AMOUNT THE STADIUM ENTITIES RECEIVED FOR THE SALE OF THE PARKING PASS FOR THE GAME, AS DETERMINED BY THE STADIUM ENTITIES; (2) REIMBURSEMENT OF ANY TRAVEL-RELATED EXPENSES; OR (3) ANY DELAY CAUSING YOU TO ARRIVE LATE OR MISS THE GAME FOR ANY REASON.
The Parking Pass must be displayed on your vehicle’s dashboard at all times. Attendants, law enforcement, or other security personnel (collectively, “Parking Attendants”) may instruct you where to park (“Directed Parking”) and may provide other directions regarding entering and exiting the parking facility. You are to follow the Parking Attendants’ instructions and all directional parking signs in or around the parking facility. Parking Attendants are not authorized to make or allow any exceptions to these Parking Pass Terms. The Parking Pass is valid for Directed Parking only, and not for a reserved parking space. You may be relocated, without remedy or refund, to an alternate parking location with a comparable value as determined in the Buccaneers’ sole discretion.
Commercial signage and/or commercial markings are not permitted to be displayed on vehicles. You may not use or enter the parking facility for advertising, promotion or any other commercial purposes (including contests, sweepstakes and giveaways) without Buccaneers’ and/or NFL’s express written consent. Use, operation, deployment, or monitoring of any aerial vehicle, including any fixed wing, rotoaircraft, drone, rocket, powered balloons, ultralights, or model aircraft, regardless of whether controlled by line of sight, radio frequency, tethers, or any other means, is prohibited at any time in or near parking facilities. Violators may be subject to prosecution and fines for violations of FAA regulated airspace restrictions. Any recording, photograph, video, or other content related to a Game obtained through the use of such aerial vehicles is prohibited and subject to confiscation.
Please be courteous to those around you. Keep drive lanes clear at all times. Your personal belongings, including chairs and grills, may not be placed in adjacent parking spaces. You may not litter or commit any nuisance or other act that may disturb the quiet enjoyment or safety of other parkers of the facility. Please keep music at a reasonable volume; audio should not be heard beyond 50 feet of your vehicle. You are responsible for your own conduct and that of your invitees, guests, and any passenger arriving in the vehicle associated with this Parking Pass, including any accompanying minors. You are prohibited from leaving pets or other animals unattended in your vehicle, and you assume the risk of any damage caused as a result of extricating any pet or other animal from the vehicle.
Resale of Parking Passes is prohibited except as permitted by Florida law. Violation of these resale restrictions may result in automatic termination of this license and admission refused for the resold Parking Pass without refund.
YOU ACKNOWLEDGE AND AGREE that by tendering this Parking Pass and entering the parking facility, you, on behalf of yourself and, to the extent permitted by law, any accompanying minor(s), invitees, guests and passengers, agree to the following additional terms, conditions and waivers:
You assume all risks incident to entering, exiting or parking in the facility, including the risk of personal injury, fire, theft, damage, or loss of your vehicle or any contents, and hereby waive any and all claims or potential claims arising from such risks, damage or injuries. No bailment is created by tendering a parking fee, entering the lot, or parking at the facility.
You further agree to release, indemnify, and hold harmless the Stadium Entities from and against any claims, losses, liability, damages, actions, suits, and expenses, including attorneys’ fees and other costs, arising out of or relating to parking at the facility or breach of these Parking Pass Terms, including any personal injury or property damage occurring in or around the parking facility, whether such claims are now existing or later arising, and whether or not such loss is alleged to be caused by the negligence, including the gross negligence, of any of the Stadium Entities. You are responsible for all damage that you, your invitees, guests, and/or any passenger arriving in the vehicle associated with this Parking Pass, cause to the parking facility, ordinary wear and tear excepted.
The Stadium Entities are not responsible for lost, stolen, destroyed, or counterfeit Parking Passes, as well as Parking Passes sold in violation of any applicable law, and may refuse to honor them. To the extent that multiple copies and print-outs of the same Parking Pass can be created, only the first copy or print-out that is presented will be valid for admission to the parking facility; Parking Passes with barcodes that have already been scanned are not valid for admission to the parking facility.
Your use of wireless Internet in and around the Stadium and parking facility (“RJSWiFi”) is subject to the terms and conditions of use which can be found at http://www.buccaneers.com/wifi/. By accessing, connecting to, and/or using RJSWiFi, you accept and agree to all such terms and conditions of use.
These Parking Pass Terms are governed by Florida law, without regard to conflict of law provisions, and by any applicable federal laws. Disputes arising out of or related to these Parking Pass Terms will be resolved individually without resort to class action. You agree to submit to the personal jurisdiction and venue of the federal and state courts comprising Hillsborough County, Florida. If any provision of these Parking Pass Terms is determined to be invalid or unenforceable, such provision will be amended to the minimum extent necessary to make such provision enforceable and the remainder of these Parking Pass Terms will not be affected, but will continue to be valid and enforceable to the fullest extent permitted by law.
