BUCCANEERS SEASON TICKET WAITLIST TERMS
These Buccaneers Season Ticket Waitlist Terms govern your participation in the waitlist for Tampa Bay Buccaneers Season Tickets. By signing up for the Buccaneers Season Ticket Waitlist, you acknowledge that you have read and are bound by the terms and conditions set forth herein.
The Buccaneers Season Ticket Waitlist provides an organized and fair process for fans to have access to Buccaneers season tickets if and when they become available. Currently, we cannot estimate availability or wait times due to our high renewal rates. Please note that placing your name on the Waitlist does not guarantee that you will have access to Buccaneers season tickets, but should tickets become available you will be subject to any then current terms of purchase as determined by the Buccaneers in its sole discretion (e.g., proof of FL residency, limitations on resale, etc.).
Signing up for the Waitlist does not obligate you to purchase. At any time prior to purchasing season tickets that become available, you or the Buccaneers may remove your name from the Waitlist for any reason and a full refund of your deposit will be issued. Your place on the Waitlist is non-transferable and non-assignable.
To add your name to the Waitlist, you must contact bucssalesteam@buccaneers.nfl.com and submit the required season ticket application and deposit. Your name will not be added to the Waitlist until we receive your application and deposit in full. All deposits will be applied towards your season ticket account balance once you purchase season tickets. We will notify you if Buccaneers season tickets become available. To ensure your name remains on the Waitlist, report any changes to your contact information as they occur. Importantly, if you provide us with any false and/or inaccurate contact information (i.e., name, address, phone number, and /or e-mail address) or fail to properly update such contact information, we reserve the right to remove your name from the Waitlist and retain your deposit.
In the event that the Buccaneers are unable to offer you season tickets for any season, your deposit automatically shall be applied to the Waitlist for the following season. You may remove your name from the Waitlist at any time by contacting bucssalesteam@buccaneers.nfl.com and your deposit will be refunded.
You authorize us and our affiliates, agents, and service providers (collectively, "Messaging Parties") to contact you using automatic dialing systems, artificial or prerecorded voice messages, texts, email, or similar methods to provide you with information about us, the Stadium, these Terms and your Waitlist status, including information about payments, games, other events or offers. You authorize the Messaging Parties to make such contacts using any telephone numbers (including wireless), texts, email addresses, or similar electronic means, you supply to the Messaging Parties, even if you are charged for the contact by your service provider. You expressly authorize the Messaging Parties to monitor and record your calls. To withdraw this authorization, send a written request by email to emarketing@buccaneers.nfl.com or by mail to: Attn: Marketing Opt-Outs, Tampa Bay Buccaneers, AdventHealth Training Center, One Buccaneer Place, Tampa, FL 33607.
FLORIDA LAW, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES, GOVERNS THESE BUCCANEERS SEASON TICKET WAITLIST TERMS AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THESE TERMS, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE CLAIMS AND TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES.
EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL CLAIMS IN ANY WAY RELATING TO OR ARISING FROM MY PARTICIPATION IN THE BUCCANEERS SEASON PASS WAITLIST SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATIORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS' MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN TAMPA, FLORIDA.
NOTWITHSTANDING THE FOREGOING, ANY TORT OR TORT-RELATED CLAIM (INCLUDING BUT NOT LIMITED TO NEGLIGENCE CLAIMS AND STATUTORY CLAIMS) IN ANY WAY RELATING TO OR ARISING FROM MY PARTICIPATION IN THE BUCCANEERS SEASON PASS WAITLIST SHALL BE LITIGATED IN A COURT OF COMPETENT JURISDICTION IN HILLSBOROUGH COUNTY, FLORIDA. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL. FURTHER, EACH PARTY WAIVES THE RIGHT TO A COURT TRIAL WITH RESPECT TO NON-TORT CLAIMS HEREUNDER.
EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY DISPUTE AGAINST ANY OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, WHETHER DURING BINDING ARBITRATION, OR LITIGATION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF COMPETENT JURISDICTION CONSTRUING THIS AGREEMENT TO BE AGAINST PUBLIC POLICY AND ANY RIGHTS TO PARTICIPATE IN, AND AGREES NOT TO PARTICIPATE IN, ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION OR COURT PROCEEDING, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER.
THE PREVAILING PARTY IN ANY PROCEEDING RELATING TO OR ARISING FROM MY PARTICIPATION IN THE BUCCANEERS SEASON PASS WAITLIST SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS' FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION OR LITIGATION AS THE CASE MAY BE, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.
