2021 Season – Single Game Ticket Terms

This ticket is a revocable license that only grants a one-time entry into Raymond James Stadium ("Stadium") and a spectator seat (or if specified on the ticket, a standing location) for the specified game (the "Event"). No person, regardless of age, may enter the Stadium without a ticket, and re-entry is prohibited. Admission may be refused or withdrawn, or ticket holder ejected, in the sole discretion of the Tampa Bay Buccaneers ("Buccaneers"), Tampa Sports Authority ("TSA"), or the National Football League ("NFL") (collectively, the "Management"). The person seeking entry pursuant to this license, and any accompanying minor (collectively, "Holder"), agrees that this ticket is subject to these terms and conditions ("Terms") and by accepting and/or using this ticket, Holder is deemed to have read the Terms and agrees to be bound by them. Failure to comply with any of these Terms shall result in forfeiture of this license and all rights arising hereunder without refund and shall entitle the Management to pursue all legal remedies available. Admission may be refused or revoked and Holder may be ejected in the sole discretion of Management.

ALL TICKET SALES ARE FINAL. NO REFUNDS OR EXCHANGES EXCEPT AS PROVIDED HEREIN. THE SOLE AND EXCLUSIVE REMEDY, including if admission is refused or revoked, if Stadium capacity limitations result in Holder's ticket(s) being cancelled, if the Event is relocated outside of Tampa, Florida, or if the Event is cancelled and not replayed for any reason (or held without fans), is an account credit or a refund of the face value of this ticket as determined by the Buccaneers in its sole discretion (the "Face Value"). Once an Event begins, it is deemed fully performed and no refunds will be given. No refund or remedy will be provided if the Event is postponed or rescheduled, or if Holder is ejected from or refused entry to Stadium. Further, Management's liability for breach of any term of this ticket shall not exceed the Face Value. IN NO EVENT SHALL MANAGEMENT BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF THE FACE VALUE FOR THIS TICKET.

The date and time of the Event (and the opening of Stadium gates) are subject to change by Management in its sole discretion, and no such changes shall entitle Holder to a refund or any other remedy if the ticket holder cannot attend the Event or for any other reason. Holder's seat may be relocated in the sole discretion of Management, and no such relocation shall entitle Holder to a refund or any other remedy provided that Holder's seat is relocated to a seat of comparable value as determined by Buccaneers in its sole discretion.

Holder agrees to comply with all Stadium & Fan Policies, including any security and fan conduct policies, health screenings (as further detailed below), and applicable bag policies (https://raymondjamesstadium.com/policies-procedures). Holder and Holder's belongings may be searched or assessed prior to or upon entry into the Stadium or at any other time while at the Stadium. Prohibited items may be confiscated and/or Holder may be denied admission or have his/her admission revoked at any time at the sole discretion of Management. Holder consents to such searches and assessments and waives all claims relating to them. If Holder does not consent to such searches and assessments, Holder acknowledges that Management has the right to deny admission to or to eject any person who Management, in its sole discretion, determines poses a risk to the health and/or safety of other attendees and/or whose conduct violates these Terms, the Fan Code of Conduct, or is otherwise disorderly (or complicit in such conduct) without refund.

Holder's use of wireless Internet in and around the Stadium ("RJSWiFi") is subject to the WiFi Terms and Acceptable Use Policy which can be found at www.buccaneers.com/wifiterms. By accessing, connecting to, and/or using RJSWiFi, Holder accepts and agrees to all such terms and conditions of use.

ASSUMPTION OF RISK. HOLDER VOLUNTARILY ASSUMES ALL RISKS, HAZARDS AND DANGERS arising from or relating in any way to the Event, including, without limitation, the risk of contracting a communicable disease or illness (including exposure to a bacteria, virus, or other pathogen capable of causing a communicable disease or illness), and the risk of lost, stolen or damaged property or personal injury of any kind (including death), whether occurring before, during, or after the Event, however caused, and hereby waives all claims and potential claims relating to such risks, hazards and dangers. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE WHERE PEOPLE ARE PRESENT, INCLUDING THOSE WITH OR WITHOUT MASKS AND ADDITIONAL PERSONAL PROTECTIVE EQUIPMENT ("PPE") OR IMPROPERLY USING MASKS OR PPE. COVID-19 IS AN EXTREMELY CONTAGIOUS VIRUS THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. ACCORDING TO THE CENTERS FOR DISEASE CONTROL AND PREVENTION, SENIOR CITIZENS AND THOSE WITH UNDERLYING MEDICAL CONDITIONS ARE ESPECIALLY VULNERABLE. BY ENTERING THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS, HOLDER VOLUNTARILY ASSUMES ALL RISKS RELATED TO EXPOSURE TO COVID-19, INCLUDING BUT NOT LIMITED TO EXPOSURE TO CARRIERS OF THE VIRUS WHO DO NOT HAVE SYMPTOMS OF COVID-19 AND/OR HOLDER TRANSMITTING THE COVID-19 VIRUS TO OTHERS DURING OR AFTER THE EVENT.

RELEASE, WAIVER AND COVENANT NOT TO SUE. On behalf of Holder and Holder's Related Persons (defined below), on whose behalf Holder represents it has the authority to act with respect to this Pass and the matters herein, Holder RELEASES, WAIVES, and COVENANTS NOT TO SUE each of the Released Parties (defined below) with respect to any and all claims, including for negligence and/or wrongful death, that Holder or any of Holder's Related Persons may have (or hereafter accrue), against any of the Released Parties, that relate to any of the risks, hazards and dangers described in the preceding paragraph, including without limitation any and all claims and damages of any kind or character that arise out of or relate in any way to (i) Holder's exposure to COVID-19; (ii) Holder's entry into, or presence within or around, an Event at the Stadium (including all risks related thereto, and including without limitation in parking areas or entry gates) or compliance with any protocols applicable to each Event; (iii) any interaction between Holder and any personnel of any of the Released Parties present at each Event; (iv) any act or omission on the part of any of the Released Parties in connection with monitoring or policing protocols applicable to each Event, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise. Holder further represents and warrants that Holder's Related Persons have reviewed these Terms and separately agreed to them. TO THE EXTENT THAT HOLDER OR ANY HOLDER'S RELATED PERSONS, OR PERSONS WHO CLAIM THAT THEY CONTRACTED COVID-19 FROM HOLDER OR HOLDER'S RELATED PERSONS, FILE A CLAIM, SUIT OR ARBITRATION AGINST ANY OF THE RELEASED PARTIES ARISING FROM OR RELATING TO THESE TERMS OR THE EVENT AT THE STADIUM, HOLDER HEREBY AGREES TO FULLY INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES AGAINST SUCH CLAIM, SUIT OR ARBITRATION TO THE FULLEST EXTENT PERMITTED BY LAW. IT IS ACKNOWLEDGED AND AGREED THAT THE RELEASED PARTIES ARE USING COMMERCIALLY REASONABLE EFFORTS TO ENSURE AND ENFORCE COMPLIANCE WITH APPLICABLE CDC GUIDELINES AND STATE AND LOCAL LAWS FOR PROTECTION AGAINST COVID-19 ("COVID-19 BEST PRACTICES"), HOWEVER, NOTWITHSTANDING, HOLDER AGREES TO RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FOR ANY FAILURE OF THE RELEASED PARTIES TO ENSURE OR ENFORCE ANY COVID-19 BEST PRACTICES.

As used herein:

· "Related Persons" means Holder's heirs, assigns, executors, administrators, next of kin, anyone attending the Event with Holder, including but not limited to minors for whom Holder is a parent or guardian (which persons Holder represents have authorized Holder to act on their behalf for purposes of the release herein), and other persons acting or purporting to act on Holder's or their behalf.

· "Released Parties" means: (i) Buccaneers Team LLC, Buccaneers Stadium LLC, Tampa Sports Authority, RJS Stadium, A Commercial Condominium Association, Hillsborough County, the City of Tampa, NFL Ventures, Inc., NFL Ventures, L.P., the National Football League and its other professional member clubs, and each of their respective direct and indirect affiliates, administrators, designees, licensees, agents, owners, officers, directors, general partners, partners, members, employees, contractors (and all employees of such contractors) and other personnel; (ii) the direct and indirect owners, lessees and sublessees of the Stadium and related stadium grounds (including, without limitation, parking areas and entry gates); (iii) all third parties performing services at the Stadium and related Stadium grounds (including, without limitation, parking areas and entry gates), including but not limited to Legends Hospitality, LLC, Fanatics Retail Group Concessions, LLC, Sentry Event Services, Inc, and Performance Clean, LLC; and (iv) any parents, subsidiaries, affiliated and related companies and officers, directors, owners, members, managers, partners, employers, employees, agents, contractors, sub-contractors, insurers, representatives, successors and/or assigns of each of the foregoing entities and persons, whether past, present or future and whether in their institutional or personal capacities.

Management is not responsible for lost, stolen, destroyed, duplicated or counterfeit tickets and may refuse to honor such tickets. Further, this ticket may not be used for, or in connection with, any form of commercial or trade purposes including, but not limited to, any advertising, promotions, contests, sweepstakes, giveaways, gambling or gaming activities, without the express written consent of the Buccaneers and/or the NFL. Use of this ticket in violation of any law is strictly prohibited and will result in seizure, revocation and/or forfeiture of this license without refund.

Holder agrees not to create, transmit, display, distribute, exploit, misappropriate or sell (or aid in such activity), in any medium now or hereafter existing: (i) any form, description or account (whether text, data or visual) and including, without limitation, play-by-play data of the Event or related events (collectively, the "Descriptive Data") for any commercial or non-personal purpose; (ii) any photographs, images, videos, audio or other form of display or public performance or reproduction of any portion of the Event or related events (the "Works") for any commercial or non-personal purpose; or (iii) livestreams of any portion of the Event or related events (the "Livestreams"). Notwithstanding the foregoing, Holder agrees that by using this ticket for entry into the Stadium, Holder shall be deemed to have signed this ticket and grants the NFL an exclusive, worldwide, irrevocable, perpetual, sub-licensable, royalty-free license to all rights associated with the Works the Livestreams, and, to the extent permitted by law, the Descriptive Data.

Holder grants irrevocable permission to the Tampa Bay Buccaneers, NFL, and their respective sponsors, licensees, advertisers, broadcasters, designees, partners and agents to use publish, distribute, edit, modify and/or alter Holder's image, likeness, voice, actions and statements in any medium including, without limitation, any audio, video, film, photographs, social media, exhibition, transmission, publication or reproduction of the Event for any purpose without further authorization or compensation, and waives all claims and potential claims relating to such use unless prohibited by law.

ARBITRATION; JURY TRIAL WAIVER; CLASS ACTION WAIVER; CHOICE OF LAW AND TORT CLAIM FORUM SELECTION. FLORIDA LAW, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES, GOVERNS THESE TICKET TERMS AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THESE TICKET TERMS, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE CLAIMS OR OTHER TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES.

EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL CLAIMS IN ANY WAY RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS' MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN TAMPA, FLORIDA.

NOTWITHSTANDING THE FOREGOING, ANY TORT OR TORT-RELATED CLAIM (INCLUDING BUT NOT LIMITED TO NEGLIGENCE CLAIMS AND STATUTORY CLAIMS) IN ANY WAY RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE LITIGATED IN A COURT OF COMPETENT JURISDICTION IN HILLSBOROUGH COUNTY, FLORIDA. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL. FURTHER, EACH PARTY WAIVES THE RIGHT TO A COURT TRIAL WITH RESPECT TO NON-TORT CLAIMS HEREUNDER.

EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY DISPUTE AGAINST ANY OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, WHETHER DURING BINDING ARBITRATION, OR LITIGATION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF COMPETENT JURISDICTION CONSTRUING THIS AGREEMENT TO BE AGAINST PUBLIC POLICY AND ANY RIGHTS TO PARTICIPATE IN, AND AGREES NOT TO PARTICIPATE IN, ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION OR COURT PROCEEDING, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER.

THE PREVAILING PARTY IN ANY PROCEEDING RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS' FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION OR LITIGATION AS THE CASE MAY BE, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM THE RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND MANAGEMENT HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IN THE ACTIVITY IF YOU DO NOT SIGN THIS FORM.

Holder agrees that by use of the ticket and entry into the Stadium (including, without limitation, parking areas and entry gates), it shall be construed that Holder has read and consented to accept these Terms with the same force and effect as if Holder signed these Terms, including but not limited to, the form waiving and assuming the risk of inherent risks on behalf of a minor child.

FAN HEALTH PROMISE

Health Screening: Holder agrees that Holder and anyone in Holder's party may be required to submit to a health screening before entering the Stadium.

· Such health screening shall be as determined by Management in its sole discretion, and may include, without limitation, an evaluation for COVID-19 symptoms, affirmation of a negative COVID-19 test, and/or confirmation Holder and Holder's party have been fully vaccinated for COVID-19.

· Management shall have the right to deny admission without a refund to Holder or anyone in Holder's party who (1) refuses to submit to a health screening, or (2) fails the health screening's conditions for admission to the Stadium, as determined by Management in its sole discretion. However, in the event that Holder or anyone in Holder's party fails the health screening, Holder shall be permitted to transfer the ticket(s) of any person who was refused admission, to another person who passes the health screening provided that such ticket pod (as outlined below) is not broken.

TICKET POD INTEGRITY: In order to maintain social distancing guidelines, Holder agrees to not sell, transfer or otherwise provide any of Holder's tickets to anyone other than family with whom Holder has been sheltering (or other trusted acquaintances), unless Holder is selling, transferring or otherwise providing all such tickets (i.e., Holder's full pod of tickets) to one party in accordance with these Terms.

If any provision of these Terms is determined to be invalid or unenforceable, such provision will be amended to the minimum extent necessary to make such provision enforceable and the remainder of these Terms will not be affected, but will continue to be valid and enforceable to the fullest extent permitted by law.

Season Pass Ticket Terms ("Terms")

By purchasing a season pass ("Pass") from the Tampa Bay Buccaneers ("Buccaneers", "we" or "us"), the season ticket holder shown on the invoice ("Member") agrees to these Terms. Neither the Terms nor any invoice sent to Member shall constitute an offer. The Terms shall not be an enforceable agreement, and a ticket subscription purchase or renewal shall not be completed, until both (a) the Member (or an authorized representative thereof) submits it to us with the appropriate acknowledgment and acceptance of the Terms (either by signature or, if on-line, by click acceptance), and (b) the Member thereafter receives a written notice from us confirming season ticket holder status.

Season Pass: The Pass is an indivisible revocable license issued annually by us that provides Member tickets to attend all pre‐season and regular season Buccaneers home games ("Event") at Raymond James Stadium ("Stadium"). Passes expire after one season and create no rights beyond that season, including no right to renew, or to specific seats. The Pass includes parking if shown on the invoice, which will be distributed electronically. Additional terms, including gameday ticket and parking terms, security and fan conduct policies, health screenings (as further detailed below), and applicable bag policies govern use of the Pass. We may at any time change or revoke these Terms, the gameday ticket and parking terms, or applicable fan policies, or add provisions in our discretion. See www.buccaneers.com/terms, and https://raymondjamesstadium.com/policies-procedures for current terms.

Pay As We Play Post-Season Tickets: Member may purchase the same ticket(s) to Tampa Bay Buccaneers post‐season games played at the Stadium, with the exception of the Super Bowl. By checking the box on the invoice or other communication, Member agrees to purchase tickets to all available post-season home games at an additional cost above and beyond the Pass. For each post-season home game, Member agrees to pay the post-season ticket cost immediately after we clinch participation in such game. Member's agreement to purchase post-season tickets, and any such tickets Member purchases through this option, are governed by these Terms.

Revocation: We may revoke a Pass at any time. If we revoke Member's Pass because of account ownership disputes or without cause, Member's exclusive remedy is a refund of amounts paid to us for which no corresponding benefits have been provided as determined in the Buccaneers' sole discretion. If we revoke a Pass due to Member's default ("Default"), Member is not entitled to a refund. Default includes (1) violating Ticket Resale or Transfer Limitations (below), (2) failing to make timely payment on the Pass, and (3) violating any other provision of these Terms or any other Buccaneers, National Football League ("NFL"), or Stadium terms or policies, which may be amended from time-to-time, including policies regulating misconduct, drunkenness or disorderly behavior at the Stadium. Member agrees it is impossible to determine at the time Member agrees to these Terms, the damage and loss we would incur due to Default. Therefore, without limiting any of our rights, if Member does not pay us by the due date and does not cure such nonpayment within ten (10) days of written notice of nonpayment, or if the Pass is otherwise revoked due to Default, we reserve the right, in our sole discretion, to (1) cancel any unissued tickets, (2) deactivate any tickets issued to future games, (3) retain all sums paid, and/or (4) demand payment in full. We have no duty to mitigate damages incurred due to Default. Any delay in enforcing any of our rights under this Agreement shall not constitute waiver of any such rights.

Ticket Resale, Transfer Limitations: The Pass, including privileges granted by the license thereunder, may not be sold, assigned, or transferred without our express written consent, which may be granted, withheld, or conditioned in our sole discretion and such consent shall only be considered once the Pass has been paid in full. Any sale, assignment, or transfer without our express written consent is void. The Pass is an indivisible revocable license. Member acknowledges that the spirit of being a season ticket holder is not financial gain or other benefit by reselling the tickets, but embodies a desire to support the Buccaneers. Member acknowledges that we may monitor resale and/or trade activity. We may revoke the pass if we determine, in our sole discretion, that Member has resold or traded tickets: (i) in violation of any applicable laws; (ii) excessively; (iii) in a way that otherwise violates the spirit of being a season ticket holder; (iv) outside of the ticket resale platforms approved by us; or (v) prior to the Pass being paid in full. See "Revocation" section for consequences of revocation. In addition to the Buccaneers' restriction on the resale or transfer of tickets as provided above, resale is prohibited by Florida law within the Stadium grounds and may result in the automatic revocation of this license, confiscation of tickets, refusal of entry into the Stadium, fine, and/or arrest.

Changes, Exchanges and Refunds: Seat relocation requests are accepted in our discretion. We may relocate Member's seat(s) at any time for any reason, and relocation does not entitle Member to a refund or other remedy if Member is relocated to a seat(s) with a comparable value as determined in our discretion. The date and time of games, opening of the gates, and opponents are subject to change. There are no refunds on Pass or ticket payments, including if Member cannot attend a game or in the event of Pass revocation, except as set forth herein or in our sole discretion.

Relocated or Unplayed Games: If fewer than ten (10) total pre‐season and regular season Tampa Bay Buccaneers games are played at the Stadium during the season due to causes or circumstances within our control, at our sole discretion we will either: (1) reduce the total amount due by the face value of the ticket, as determined by the Buccaneers in its sole discretion, for the game(s) not played at the Stadium (the "Face Value"); (2) credit Member's Pass account for the Face Value; or (3) refund Member the Face Value. If any scheduled Tampa Bay Buccaneers home game at the Stadium is played without fans, cancelled and not rescheduled, or relocated outside of Tampa, Florida (each, an "Affected Game") due to any cause or circumstance whatsoever beyond our control, including but not limited to strike (including a National Football League Players Association strike), lockout (including an NFL lockout), civil violence, inability to procure material, failure of electricity or other utilities, restrictive governmental laws or regulations promulgated subsequent to the date of this Agreement, riots, insurrection, wars, inclement weather, fire or other casualty, acts of god, acts or threats of terrorism, global health emergencies, pandemics, epidemics and/or actual or anticipated public health crisis' (each a "Force Majeure Event"), then Member remains obligated to pay all sums due under these Terms but we will credit your Pass account for the Face Value of such Affected Game. Any credit hereunder shall be applied towards the payment of season or single game tickets for the immediately succeeding NFL season. Any unused credit will expire after that NFL season and shall be forfeited. If any portion of a Buccaneers home game is played and subsequently cancelled, such game will not be deemed to have been "cancelled" for the purposes of this Agreement.

Communications: Member authorizes us and our affiliates, agents, and service providers (collectively, "Messaging Parties") to contact Member using automatic dialing systems, artificial or prerecorded voice messages, texts, email, or similar methods to provide you with information about us, the Stadium, these Terms and your Pass, including information about payments, games, other events or offers. Member authorizes the Messaging Parties to make such contacts using any telephone numbers (including wireless), texts, email addresses, or similar electronic means, Member supplies to the Messaging Parties, even if member is charged for the contact by Member's service provider. Member expressly authorizes the Messaging Parties to monitor and record Member's calls. To withdraw this authorization, send a written request by email to emarketing@buccaneers.nfl.com or by mail to: Attn: Marketing Opt-Outs, Tampa Bay Buccaneers, AdventHealth Training Center, One Buccaneer Place, Tampa, FL 33607.

Member's use of wireless Internet in and around the Stadium ("RJSWiFi") is subject to the WiFi Terms and Acceptable Use Policy which can be found at www.buccaneers.com/wifiterms. By accessing, connecting to, and/or using RJSWiFi, Holder accepts and agrees to all such terms and conditions of use.

Assumption of Risk: MEMBER VOLUNTARILY ASSUMES (AND SHALL CAUSE ANYONE IN MEMBER'S PARTY OR OTHERWISE USING MEMBER'S TICKET(S) TO ASSUME) ALL RISKS, HAZARDS AND DANGERS arising from or relating to attending a Buccaneers home game at the Stadium, including, without limitation, the risk of contracting a communicable disease or illness (including exposure to a bacteria, virus, or other pathogen capable of causing a communicable disease or illness), and the risk of lost, stolen or damaged property or personal injury of any kind (including death), whether occurring before, during, or after any Buccaneers home game, however caused, and hereby waives all claims and potential claims relating to such risks, hazards and dangers. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE WHERE PEOPLE ARE PRESENT, INCLUDING THOSE WITH OR WITHOUT MASKS AND ADDITIONAL PERSONAL PROTECTIVE EQUIPMENT ("PPE") OR IMPROPERLY USING MASKS OR PPE. COVID-19 IS AN EXTREMELY CONTAGIOUS VIRUS THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. ACCORDING TO THE CENTERS FOR DISEASE CONTROL AND PREVENTION, SENIOR CITIZENS AND THOSE WITH UNDERLYING MEDICAL CONDITIONS ARE ESPECIALLY VULNERABLE. BY ENTERING THE STADIUM AND RELATED STADIUM GROUNDS (INCLUDING, WITHOUT LIMITATION, PARKING AREAS AND ENTRY GATES), MEMBER VOLUNTARILY ASSUMES ALL RISKS RELATED TO EXPOSURE TO COVID-19, INCLUDING BUT NOT LIMITED TO EXPOSURE TO CARRIERS OF THE VIRUS WHO DO NOT HAVE SYMPOTOMS OF COVID-19 AND/OR MEMBER TRANSMITTING THE COVID-19 VIRUS TO OTHERS DURING OR AFTER THE EVENT.

Release, Waiver & Covenant Not To Sue: On behalf of Member and Member's Related Persons (defined below), on whose behalf Member represents it has the authority to act with respect to this Pass and the matters herein, Member RELEASES, WAIVES, and COVENANTS NOT TO SUE each of the Released Parties (defined below) with respect to any and all claims, including for negligence and/or wrongful death, that Member or any of Member's Related Persons may have (or hereafter accrue), against any of the Released Parties, that relate to any of the risks, hazards and dangers described in the preceding paragraph, including without limitation any and all claims and damages of any kind or character that arise out of or relate in any way to (i) Member's exposure to COVID-19; (ii) Member's entry into, or presence within or around, an Event at the Stadium (including all risks related thereto, and including without limitation in parking areas or entry gates) or compliance with any protocols applicable to each Event; or (iii) any interaction between Member and any personnel of any of the Released Parties present at each Event; (iv) any act or omission on the part of Stadium or any of the Released Parties in connection with monitoring or enforcing protocols applicable to each Event, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise. Member further represents and warrants that Member's Related Persons have reviewed these terms and separately agreed to them. TO THE EXTENT THAT MEMBER OR ANY MEMBER'S RELATED PERSONS FILE A CLAIM, SUIT OR ARBITRATION AGINST ANY OF THE RELEASED PARTIES ARISING FROM OR RELATING TO THESE TERMS OR THE EVENT AT THE STADIUM, MEMBER HEREBY AGREES TO FULLY INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES AGAINST SUCH CLAIM, SUIT OR ARBITRATION TO THE FULLEST EXTENT PERMITTED BY LAW. IT IS ACKNOWLEDGED AND AGREED THAT THE RELEASED PARTIES ARE USING COMMERCIALLY REASONABLE EFFORTS TO ENSURE AND ENFORCE COMPLIANCE WITH APPLICABLE CDC GUIDELINES AND STATE AND LOCAL LAWS FOR PROTECTION AGAINST COVID-19 ("COVID-19 BEST PRACTICES"), HOWEVER, NOTWITHSTANDING, MEMBER AGREES TO RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FOR ANY FAILURE OF THE RELEASED PARTIES TO ENSURE OR ENFORCE ANY COVID-19 BEST PRACTICES.

As used herein:

  • "Related Persons" means Member's heirs, assigns, executors, administrators, next of kin, anyone attending the game with Member, including but not limited to minors for whom Member is a parent or guardian or otherwise using Member's ticket(s) (which persons Member represents have authorized Member to act on their behalf for purposes of the release herein), and other persons acting or purporting to act on Member's or their behalf.
  • "Released Parties" means: (i) Buccaneers Team LLC, Buccaneers Stadium LLC, Tampa Sports Authority, RJS Stadium, A Commercial Condominium Association, Hillsborough County, the City of Tampa, NFL Ventures, Inc., NFL Ventures, L.P., the National Football League and its other professional member clubs, and each of their respective direct and indirect affiliates, administrators, designees, licensees, agents, owners, officers, directors, general partners, partners, members, employees, contractors (and all employees of such contractors) and other personnel; (ii) the direct and indirect owners, lessees and sublessees of the Stadium and related stadium grounds (including, without limitation, parking areas and entry gates); (iii) all third parties performing services at the Stadium and related Stadium grounds (including, without limitation, parking areas and entry gates), including but not limited to Legends Hospitality, LLC, Fanatics Retail Group Concessions, LLC, Sentry Event Services, Inc., and Performance Clean, LLC; and (iv) any parents, subsidiaries, affiliated and related companies and officers, directors, owners, members, managers, partners, employers, employees, agents, contractors, sub-contractors, insurers, representatives, successors and/or assigns of each of the foregoing entities and persons, whether past, present or future and whether in their institutional or personal capacities.

ADDITIONALLY, BY PURCHASING A PASS, MEMBER WAIVES AND DISCHARGES, AND RELEASES AND HOLDS HARMLESS, THE BUCCANEERS AND ITS AFFILIATES FOR ANY AND ALL CLAIMS RELATING IN ANY WAY TO PRIOR PASSES OR OTHER TICKET OR HOSPITALITY PURCHASES AND ANY PURPORTED RIGHTS HOLDER MAY ASSERT IN CONNECTION THEREWITH.

Other Terms: Ticket sales are subject to a surcharge imposed by the Tampa Sports Authority; if we determine an adjustment to the surcharge is required, it will be provided within sixty (60) days of the determination date. We may charge a $25 fee for any returned, unpaid, or unprocessed check, electronic debit, or similar payment instrument. In the event of a dispute between Member and us related to your failure to make timely payment(s), the prevailing party is entitled to recover attorneys' fees and costs related to the arbitration of such dispute, including appellate proceedings. These Terms will be construed and enforced in accordance with the law of Florida without regard to conflict of laws. If any provision of these Terms is invalid or unenforceable, such provision will be amended to the minimum extent necessary to make such provision enforceable and the remainder of these Terms will not be affected.

ARBITRATION; JURY TRIAL WAIVER; CLASS ACTION WAIVER; CHOICE OF LAW AND TORT CLAIM FORUM SELECTION: FLORIDA LAW, WITHOUT REGARD TO CONFLICT OF LAW, GOVERNS THESE SEASON PASS TERMS AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THESE SEASON PASS TERMS, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE CLAIMS OR OTHER TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES.

EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL CLAIMS IN ANY WAY RELATING TO OR ARISING FROM MEMBER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS' MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN TAMPA, FLORIDA.

NOTWITHSTANDING THE FOREGOING, ANY TORT OR TORT-RELATED CLAIM (INCLUDING BUT NOT LIMITED TO NEGLIGENCE CLAIMS AND STATUTORY CLAIMS) IN ANY WAY RELATING TO OR ARISING FROM MEMBER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE LITIGATED IN A COURT OF COMPETENT JURISDICTION IN HILLSBOROUGH COUNTY, FLORIDA. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL. FURTHER, EACH PARTY WAIVES THE RIGHT TO A COURT TRIAL WITH RESPECT TO NON-TORT CLAIMS HEREUNDER.

EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY DISPUTE AGAINST ANY OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, WHETHER DURING BINDING ARBITRATION, OR LITIGATION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF COMPETENT JURISDICTION CONSTRUING THIS AGREEMENT TO BE AGAINST PUBLIC POLICY AND ANY RIGHTS TO PARTICIPATE IN, AND AGREES NOT TO PARTICIPATE IN, ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION OR COURT PROCEEDING, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER.

THE PREVAILING PARTY IN ANY PROCEEDING RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS' FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION OR LITIGATION AS THE CASE MAY BE, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND BUCCANEERS HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IN THE ACTIVITY IF YOU DO NOT SIGN THIS FORM.

I agree that by use of the Ticket and entry into the Stadium and related Stadium grounds (including, without limitation, parking areas and entry gates), it shall be construed that I have read and consented to accept these Terms with the same force and effect as if I signed these Terms, including but not limited to, the form waiving and assuming the risk of inherent risks on behalf of a minor child.

FAN HEALTH PROMISE

Health Screening: Member agrees that Member and anyone in Member's party may be required to submit to a health screening before entering the Stadium.

  • Such health screening shall be as determined by the Buccaneers in its sole discretion, and may include, without limitation, an evaluation for COVID-19 symptoms, affirmation of a negative COVID-19 test, and/or confirmation Member and Member's party have been fully vaccinated for COVID-19.
  • Buccaneers shall have the right to deny admission without a refund to Member or anyone in Member's party who (1) refuses to submit to a health screening, or (2) fails the health screening's conditions for admission to the Stadium, as determined by the Buccaneers in its sole discretion. However, in the event that Member or anyone in Member's party fails the health screening, Member shall be permitted to transfer the ticket(s) of any person who was refused admission to another person who passes the health screening provided that such ticket pod (as outlined below) is not broken.

Ticket Pod Integrity: In addition to the Buccaneers' restriction on the resale or transfer of tickets as provided above, in order to maintain social distancing guidelines, Member agrees to not sell, transfer or otherwise provide any of Member's tickets to anyone other than family with whom Member has been sheltering (or other trusted acquaintances), unless Member is selling, transferring or otherwise providing all such tickets (i.e., Member's full pod of tickets) to one party in accordance with these Terms.

EACH TME A MEMBER OR MEMBER'S RELATED PERSON ENTERS THE STADIUM AND RELATED STADIUM GROUNDS (INCLUDING, WITHOUT LIMITATION, PARKING AREAS AND ENTRY GATES), PURSUANT TO A PASS, IT SHALL BE CONSTRUED AS A SEPARATE AGREEMENT TO THE SEASON PASS TICKET TERMS EXISTING ON THAT DATE.

If any provision of these Terms is determined to be invalid or unenforceable, such provision will be amended to the minimum extent necessary to make such provision enforceable and the remainder of these Terms will not be affected, but will continue to be valid and enforceable to the fullest extent permitted by law.

IF MEMBER ON BEHALF OF HIMSELF/HERSELF OR ANY RELATED PERSONS, OR ANY MEMBER'S RELATED PERSONS DO NOT CONSENT TO ALL OF THE TERMS IN ALL PARAGRAPHS SET FORTH, SUCH PERSON MUST LEAVE OR NOT ENTER THE STADIUM AND RELATED STADIUM GROUNDS (INCLUDING, WITHOUT LIMITATION, PARKING AREAS AND ENTRY GATES). BY ENTERING ANY OF THESE AREAS, MEMBER AND MEMBER'S RELATED PERSONS AGREED TO THESE SEASON PASS TERMS.

THE BELOW APPLIES ONLY IF YOU ENROLLED IN THE 12-MONTH PAYMENT PLAN:

12-Month Payment Plan Automatic Renewal

If Member enrolled in the 12-Month Payment Plan, Member agrees that we may, in our sole discretion, automatically renew Member's Pass and Member's agreement to participate in the 12-Month Payment Plan. We have the sole discretion to set the renewal terms and conditions, including at higher prices, on different terms and conditions, or for different seat locations. To prevent auto renewal, provide written notice at any time before the final payment of the current Pass is due. Written notices must be sent to: Guest and Member Relations, attn. Season Pass Cancellation, Tampa Bay Buccaneers, AdventHealth Training Center, One Buccaneer Place, Tampa, Florida 33607. All renewals are subject to these Terms until or unless new terms are issued in conjunction with the new NFL season. If any provision contained in these Terms conflicts with any provision the new terms, the provision contained in the new terms will govern and control.

12-Month Payment Plan Price Increases After Enrollment or Renewal

We set Pass prices annually. The initial disclosure of payments due on the 12-Month Payment Plan is based on the prior season Pass price, which is subject to increase by us in our sole discretion. Once the Pass price is finalized, we will notify Member of the final payment schedule and pricing through a new invoice, email, or other written communication (collectively, "Notification"). If prices are increased, a new payment schedule with higher monthly payments will be established for the remaining payments. The new monthly payment amount will be determined by subtracting the amount already paid for the upcoming full season from the new season pass price, and dividing the resulting amount by the number of remaining payments.

Once Member enrolls in the monthly payment plan, or Member's enrollment is renewed, Member agrees that he/she may not cancel his or her agreement to purchase the Pass, even if we increase the price for the Pass, provided that the Pass price is not increased by more than 7.5% (excluding the Game Upgrade surcharge referenced below, parking, taxes and other fees). However, if we increase the price of Member's Pass by more than 7.5% (excluding the Game Upgrade surcharge referenced below, parking, taxes and other fees) in any year, Member may cancel Member's Pass by sending written notice to the Buccaneers postmarked no later than twenty‐one (21) days after the Notification of such increase is sent. Separately, for any season in which the Tampa Bay Buccaneers host a ninth (9th) regular season home game, a Game Upgrade surcharge of up to 10% of the cost of the Pass (excluding parking, taxes or other fees) will also be added for that season.

EPrice Increase Cancellations: In the event member cancels in accordance with these Terms, Member can either (1) use the amount already paid as a credit to purchase single game or group tickets to Buccaneers home games during the upcoming NFL season, or (2) receive a full refund of all amounts already paid. To cancel, notify us in writing at: Guest and Member Relations, Attn: Season Pass Cancellations, Tampa Bay Buccaneers, AdventHealth Training Center, One Buccaneer Place, Tampa, FL 33607. Refunds will not be issued until thirty (30) days after the twenty-one (21) day notice period expires.

Premium Ticket Terms (Suites, Legends Club, Hall of Fame Club)

This ticket is a revocable license that only grants a one-time entry into Raymond James Stadium ("Stadium") and a spectator seat (or if specified on the ticket, a standing location) for the specified game (the "Event"). No person, regardless of age, may enter the Stadium without a ticket, and re-entry is prohibited. Admission may be refused or withdrawn, or ticket holder ejected, in the sole discretion of the Tampa Bay Buccaneers ("Buccaneers"), Tampa Sports Authority ("TSA"), or the National Football League ("NFL") (collectively, the "Management"). The person seeking entry pursuant to this license, and any accompanying minor (collectively, "Holder"), agrees that this ticket is subject to these terms and conditions ("Terms") and by accepting and/or using this ticket, Holder is deemed to have read the Terms and agrees to be bound by them. Failure to comply with any of these Terms shall result in forfeiture of this license and all rights arising hereunder without refund and shall entitle the Management to pursue all legal remedies available. Admission may be refused or revoked and Holder may be ejected in the sole discretion of Management.

All prior agreements between the Holder and Buccaneers shall remain in effect unless superseded by these Premium Ticket Terms. Should a conflict arise between these Premium Ticket Terms and Holder's written agreement with the Buccaneers (e.g., Suite License Agreement, Legends Club Agreement, Hall of Fame Agreement), these Premium Ticket Terms shall prevail.

ASSUMPTION OF RISK. HOLDER VOLUNTARILY ASSUMES ALL RISKS, HAZARDS AND DANGERS arising from or relating in any way to the Event, including, without limitation, the risk of contracting a communicable disease or illness (including exposure to a bacteria, virus, or other pathogen capable of causing a communicable disease or illness), and the risk of lost, stolen or damaged property or personal injury of any kind (including death), whether occurring before, during, or after the Event, however caused, and hereby waives all claims and potential claims relating to such risks, hazards and dangers. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE WHERE PEOPLE ARE PRESENT, INCLUDING THOSE WITH OR WITHOUT MASKS AND ADDITIONAL PERSONAL PROTECTIVE EQUIPMENT ("PPE") OR IMPROPERLY USING MASKS OR PPE. BY ENTERING THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS, HOLDER VOLUNTARILY ASSUMES ALL RISKS RELATED TO EXPOSURE TO COVID-19, INCLUDING BUT NOT LIMITED TO EXPOSURE TO CARRIERS OF THE VIRUS WHO DO NOT HAVE SYMPTOMS OF COVID-19 AND/OR HOLDER TRANSMITTING THE COVID-19 VIRUS TO OTHERS DURING OR AFTER THE EVENT.

RELEASE, WAIVER AND COVENANT NOT TO SUE. On behalf of Holder and Holder's Related Persons (defined below), on whose behalf Holder represents it has the authority to act with respect to this Pass and the matters herein, Holder RELEASES, WAIVES, and COVENANTS NOT TO SUE each of the Released Parties (defined below) with respect to any and all claims, including for negligence and/or wrongful death, that Holder or any of Holder's Related Persons may have (or hereafter accrue), against any of the Released Parties, that relate to any of the risks, hazards and dangers described in the preceding paragraph, including without limitation any and all claims and damages of any kind or character that arise out of or relate in any way to (i) Holder's exposure to COVID-19; (ii) Holder's entry into, or presence within or around, an Event at the Stadium (including all risks related thereto, and including without limitation in parking areas or entry gates) or compliance with any protocols applicable to each Event; (iii) any interaction between Holder and any personnel of any of the Released Parties present at each Event; (iv) any act or omission on the part of Stadium or any of the Released Parties in connection with monitoring or policing protocols applicable to each Event, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise. Holder further represents and warrants that Holder's Related Persons have reviewed these terms and separately agreed to them. TO THE EXTENT THAT HOLDER OF ANY HOLDER'S RELATED PERSONS, OR PERSONS WHO CLAIM THAT THEY CONTRACTED COVID-19 FROM HOLDER OR HOLDER'S RELATED PERSONS, FILE A CLAIM, SUIT OR ARBITRATION AGINST ANY OF THE RELEASED PARTIES ARISING FROM OR RELATING TO THESE TERMS OR THE EVENT AT THE STADIUM, HOLDER HEREBY AGREES TO FULLY INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES AGAINST SUCH CLAIM, SUIT OR ARBITRATION TO THE FULLEST EXTENT PERMITTED BY LAW. IT IS ACKNOWLEDGED AND AGREED THAT THE RELEASED PARTIES ARE USING COMMERCIALLY REASONABLE EFFORTS TO ENSURE AND ENFORCE COMPLIANCE WITH APPLICABLE CDC GUIDELINES AND STATE AND LOCAL LAWS FOR PROTECTION AGAINST COVID-19 ("COVID-19 BEST PRACTICES"), HOWEVER, NOTWITHSTANDING, HOLDER AGREES TO RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FOR ANY FAILURE OF THE RELEASED PARTIES TO ENSURE OR ENFORCE ANY COVID-19 BEST PRACTICES.

As used herein:

· "Related Persons" means Holder's heirs, assigns, executors, administrators, next of kin, anyone attending the Event with Holder, including but not limited to minors for whom Holder is a parent or guardian (which persons Holder represents have authorized Holder to act on their behalf for purposes of the release herein), and other persons acting or purporting to act on Holder's or their behalf.

· "Released Parties" means: (i) Buccaneers Team LLC, Buccaneers Stadium LLC, Tampa Sports Authority, RJS Stadium, A Commercial Condominium Association, Hillsborough County, the City of Tampa, NFL Ventures, Inc., NFL Ventures, L.P., the National Football League and its other professional member clubs, and each of their respective direct and indirect affiliates, administrators, designees, licensees, agents, owners, officers, directors, general partners, partners, members, employees, contractors (and all employees of such contractors) and other personnel; (ii) the direct and indirect owners, lessees and sublessees of the Stadium and related Stadium grounds (including, without limitation, parking areas and entry gates); (iii) all third parties performing services at the Stadium and related Stadium grounds (including, without limitation, parking areas and entry gates), including but not limited to Legends Hospitality, LLC, Fanatics Retail Group Concessions, LLC, Sentry Event Services, Inc, and Performance Clean, LLC; and (iv) any parents, subsidiaries, affiliated and related companies and officers, directors, owners, members, managers, partners, employers, employees, agents, contractors, sub-contractors, insurers, representatives, successors and/or assigns of each of the foregoing entities and persons, whether past, present or future and whether in their institutional or personal capacities.

ARBITRATION; JURY TRIAL WAIVER; CLASS ACTION WAIVER; CHOICE OF LAW AND TORT CLAIM FORUM SELECTION. FLORIDA LAW, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES, GOVERNS THESE TICKET TERMS AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THESE TICKET TERMS, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE CLAIMS OR OTHER TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES.

EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL CLAIMS IN ANY WAY RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS' MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN TAMPA, FLORIDA.

NOTWITHSTANDING THE FOREGOING, ANY TORT OR TORT-RELATED CLAIM (INCLUDING BUT NOT LIMITED TO NEGLIGENCE CLAIMS AND STATUTORY CLAIMS) IN ANY WAY RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE LITIGATED IN A COURT OF COMPETENT JURISDICTION IN HILLSBOROUGH COUNTY, FLORIDA. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL. FURTHER, EACH PARTY WAIVES THE RIGHT TO A COURT TRIAL WITH RESPECT TO NON-TORT CLAIMS HEREUNDER.

EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY DISPUTE AGAINST ANY OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, WHETHER DURING BINDING ARBITRATION, OR LITIGATION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF COMPETENT JURISDICTION CONSTRUING THIS AGREEMENT TO BE AGAINST PUBLIC POLICY AND ANY RIGHTS TO PARTICIPATE IN, AND AGREES NOT TO PARTICIPATE IN, ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION OR COURT PROCEEDING, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER.

THE PREVAILING PARTY IN ANY PROCEEDING RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS' FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION OR LITIGATION AS THE CASE MAY BE, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND MANAGEMENT HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IN THE ACTIVITY IF YOU DO NOT SIGN THIS FORM.

Holder agrees that by use of the Ticket and entry into the Stadium and related Stadium grounds (including, without limitation, parking areas and entry gates), it shall be construed that Holder has read and consented to accept these Terms with the same force and effect as if Holder signed these Terms, including but not limited to, the form waiving and assuming the risk of inherent risks on behalf of a minor child.

FAN HEALTH PROMISE

Health Screening: Holder agrees that Holder and anyone in Holder's party may be required to submit to a health screening before entering the Stadium.

  • Such health screening shall be as determined by Management in its sole discretion, and may include, without limitation, an evaluation for COVID-19 symptoms, affirmation of a negative COVID-19 test, and/or confirmation Holder and Holder's party have been fully vaccinated for COVID-19.
  • Management shall have the right to deny admission without a refund to Holder or anyone in Holder's party who (1) refuses to submit to a health screening, or (2) fails the health screening's conditions for admission to the Stadium, as determined by Management in its sole discretion. However, in the event that Holder or anyone in Holder's party fails the health screening, Holder shall be permitted to transfer the ticket(s) of any person who was refused admission to another person who passes the health screening provided that such ticket pod (as outlined below) is not broken.

TICKET POD INTEGRITY:

In order to maintain social distancing guidelines, Holder agrees to not sell, transfer or otherwise provide any of Holder's tickets to anyone other than family with whom Holder has been sheltering (or other trusted acquaintances), unless Holder is selling, transferring or otherwise providing all such tickets (i.e., Holder's full pod of tickets) to one party in accordance with these Terms.

If any provision of these Terms is determined to be invalid or unenforceable, such provision will be amended to the minimum extent necessary to make such provision enforceable and the remainder of these Terms will not be affected, but will continue to be valid and enforceable to the fullest extent permitted by law.

IF HOLDER ON BEHALF OF HIMSELF OR ANY RELATED PERSONS, OR ANY HOLDER'S RELATED PERSONS DO NOT CONSENT TO ALL OF THE TERMS IN ALL PARAGRAPHS SET FORTH ABOVE, SUCH PERSON MUST LEAVE OR NOT ENTER THE STADIUM OR RELATED STADIUM GROUNDS (INCLUDING, WITHOUT LIMITATION, PARKING AREAS AND ENTRY GATES). BY ENTERING ANY OF THESE AREAS, HOLDER AND HOLDER'S RELATED PERSONS AGREED TO THESE TERMS.

2021 Season – Buccaneers Parking Terms

The parking pass ("Parking Pass") is a revocable license for the Parking Pass holder, and any accompanying minors, invitees, guests and passengers (collectively "Holder") to enter an authorized parking facility at or adjacent to Raymond James Stadium ("Stadium") and occupy one parking space during the designated Tampa Bay Buccaneers game and related events (the "Event"). The Parking Pass may be revoked at any time and for any reason in the sole discretion of the Tampa Sports Authority ("TSA") or the Tampa Bay Buccaneers ("Buccaneers"), and each of their respective employees, officers, directors, owners, members, agents, or contractors (collectively, the "Management"). Holder agrees that this Parking Pass is subject to these terms and conditions ("Terms") and by using this Parking Pass for the Event, Holder is deemed to have read the Terms and agrees to be bound by them.

No refund or remedy will be provided if the Parking Pass is revoked due to (i) Holder's disorderly conduct, or (ii) Holder's breach of Stadium policies or parking rules, including these Terms. If the Parking Pass is revoked for any other reason, THE SOLE AND EXCLUSIVE REMEDY is an account credit or refund of up to the amount Buccaneers received for the sale of the Parking Pass for the Event, as determined by Buccaneers. Once Holder presents the Parking Pass and enters the parking facility, the Parking Pass is deemed used, and Holder will not be entitled to a refund if the Event is canceled or terminated early for any reason. Management's liability for any breach of any these Terms shall not exceed the amount Buccaneers received for the sale of the Parking Pass for the Event, as determined by Buccaneers in its sole discretion. IN NO EVENT SHALL MANAGEMENT BE LIABLE TO HOLDER OR ANYONE CLAIMING THROUGH HOLDER OR ON HOLDER'S BEHALF FOR (1) ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING ANY AMOUNT PAID FOR THIS PARKING PASS TO A THIRD PARTY IN EXCESS OF THE AMOUNT MANAGEMENT RECEIVED FOR THE SALE OF THE PARKING PASS FOR THE EVENT, AS DETERMINED BY MANAGEMENT; (2) REIMBURSEMENT OF ANY TRAVEL-RELATED EXPENSES; OR (3) ANY DELAY CAUSING YOU TO ARRIVE LATE OR MISS THE EVENT FOR ANY REASON.

The Parking Pass receipt, if provided, must be prominently displayed on Holder's vehicle dashboard at all times. Attendants, law enforcement, or other security personnel (collectively, "Parking Attendants") may instruct Holder where to park ("Directed Parking") and may provide other directions regarding entering and exiting the parking facility. Holder agrees to follow the Parking Attendants' instructions and all directional parking signs in or around the parking facility. Parking Attendants are not authorized to make or allow any exceptions to these Terms. The Parking Pass is valid for Directed Parking only, and not for a reserved parking space. Holder may be relocated, without remedy or refund, to an alternate parking location with a comparable value as determined in Management's sole discretion.

Holder may not display commercial signage, and/or commercial markings on or around vehicles or the parking facilities. Holder may not use the Parking Pass or enter the parking facility for advertising, promotion or any other commercial purposes (including contests, sweepstakes and giveaways) without Buccaneers' and/or NFL's express written consent. Use, operation, deployment, or monitoring of any unmanned aerial vehicle or similar device is prohibited in or near parking facilities or the Stadium. Any recording, photograph, video, or other content related to an Event obtained through the use of such unmanned aerial vehicle or similar device is prohibited and subject to confiscation.

Holder must at all times adhere to the Fan Code of Conduct (https://raymondjamesstadium.com/policies-procedures) and be courteous to those around you. Keep drive lanes clear at all times. Personal belongings, including chairs and grills, may not be placed in adjacent parking spaces. Holder may not litter or commit any nuisance or other act that may disturb the quiet enjoyment or safety of others in the parking facility. Please keep music at a reasonable volume; audio should not be heard beyond 50 feet of Holder's vehicle and shall not disturb other Event guests. Holder is responsible for its own conduct and that of Holder's invitees, guests, and any passenger arriving in the vehicle associated with this Parking Pass, including any accompanying minors. Holder is prohibited from leaving pets or other animals unattended in a vehicle, and Holder assumes the risk of any damage caused as a result of extricating any pet or other animal from the vehicle.

Resale of Parking Passes is prohibited. Violation of these resale restrictions may result in automatic termination of this license and admission refused for the resold Parking Pass without refund.

No bailment is created by tendering a parking fee, entering the lot, or parking at the facility.

Holder's use of wireless Internet in and around the Stadium and parking facility ("RJSWiFi") is subject to the WiFi Terms and Acceptable Use Policy which can be found at www.buccaneers.com/wifiterms. By accessing, connecting to, and/or using RJSWiFi, Holder accepts and agrees to all such terms and conditions of use.

ASSUMPTION OF RISK. HOLDER VOLUNTARILY ASSUMES ALL RISKS, HAZARDS AND DANGERS incident to entering, exiting or parking in the facility, including without limitation, the risk of contracting a communicable disease or illness (including exposure to a bacteria, virus, or other pathogen capable of causing a communicable disease or illness), the risk of personal injury, fire, theft, damage, or loss of Holder's vehicle or any contents, and hereby waives any and all claims or potential claims arising from such risks, damage or injuries. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE WHERE PEOPLE ARE PRESENT, INCLUDING THOSE WITH OR WITHOUT MASKS AND ADDITIONAL PERSONAL PROTECTIVE EQUIPMENT ("PPE") OR IMPROPERLY USING MASKS OR PPE. COVID-19 IS AN EXTREMELY CONTAGIOUS VIRUS THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. ACCORDING TO THE CENTERS FOR DISEASE CONTROL AND PREVENTION, SENIOR CITIZENS AND THOSE WITH UNDERLYING MEDICAL CONDITIONS ARE ESPECIALLY VULNERABLE. BY ENTERING THE PARKING FACILITY, HOLDER VOLUNTARILY ASSUMES ALL RISKS RELATED TO EXPOSURE TO COVID-19, INCLUDING BUT NOT LIMITED TO EXPOSURE TO CARRIERS OF THE VIRUS WHO DO NOT HAVE SYMPTOMS OF COVID-19 AND/OR HOLDER TRANSMITTING THE COVID-19 VIRUS TO OTHERS DURING OR AFTER THE EVENT.

RELEASE, WAIVER AND COVENANT NOT TO SUE. On behalf of Holder and Holder's Related Persons (defined below), on whose behalf Holder represents it has the authority to act with respect to this ticket and the matters herein, Holder RELEASES, WAIVES, and COVENANTS NOT TO SUE each of the Released Parties (defined below) with respect to any and all claims including for negligence and/or wrongful death that Holder or any of Holder's Related Persons may have (or hereafter accrue), against any of the Released Parties, that relate to any of the risks, hazards and dangers described in the preceding paragraph, including without limitation any and all claims and damages of any kind or character that arise out of or relate in any way to (i) Holder's exposure to COVID-19; (ii) Holder's entry into, or presence within or around, the parking facility or compliance with any protocols applicable to the Event; or (iii) any interaction between Holder and any personnel of any of the Released Parties present in or around the parking facility or at the Event; (iv) any act or omission on the part of Stadium or any of the Released Parties in connection with monitoring or enforcing protocols, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise. Holder further represents and warrants that Holder's Related Persons have reviewed these Terms and separately agreed to them. TO THE EXTENT THAT HOLDER OR ANY HOLDER'S RELATED PERSONS, OR PERSONS WHO CLAIM THAT THEY CONTRACTED COVID-19 FROM HOLDER OR HOLDER'S RELATED PERSONS, FILE A CLAIM, SUIT OR ARBITRATION AGINST ANY OF THE RELEASED PARTIES ARISING FROM OR RELATING TO THESE TERMS OR THE EVENT, HOLDER HEREBY AGREES TO FULLY INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES AGAINST SUCH CLAIM, SUIT OR ARBITRATION TO THE FULLEST EXTENT PERMITTED BY LAW. Management is not responsible for lost, stolen, destroyed, or counterfeit Parking Passes, as well as Parking Passes sold in violation of any applicable law, and may refuse to honor them. To the extent that duplicates of the same Parking Pass can be created, only the first Parking Pass presented will be valid for admission to the parking facility; Parking Passes with barcodes that have already been scanned are not valid for admission to the parking facility.

EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF MANAGEMENT USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND MANAGEMENT HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IN THE ACTIVITY IF YOU DO NOT SIGN THIS FORM.

Holder agrees that by use of the parking pass and entry into the parking facility and related Stadium grounds, it shall be construed that Holder has read and consented to accept these Terms with the same force and effect as if Holder signed these Terms, including but not limited to, the form waiving and assuming the risk of inherent risks on behalf of a minor child.

If any provision of these Terms is determined to be invalid or unenforceable, such provision will be amended to the minimum extent necessary to make such provision enforceable and the remainder of these Terms will not be affected, but will continue to be valid and enforceable to the fullest extent permitted by law.

IF HOLDER ON BEHALF OF HIMSELF/HERSELF OR ANY RELATED PERSONS, OR ANY HOLDER'S RELATED PERSONS DO NOT CONSENT TO ALL OF THE TERMS IN ALL PARAGRAPHS SET FORTH, SUCH PERSON MUST NOT ENTER THE STADIUM OR RELATED STADIUM GROUNDS (INCLUDING, WITHOUT LIMITATION, PARKING AREAS AND ENTRY GATES). BY ENTERING ANY OF THESE AREAS, HOLDER AND HOLDER'S RELATED PERSONS AGREED TO THESE TERMS.

WiFi Terms and Acceptable Use Policy

The Tampa Bay Buccaneers (including Buccaneers Team LLC and Buccaneers Stadium LLC) ("Buccaneers", "we" or "us") are pleased to offer complimentary wireless networking access (the "WiFi Service") to guests and fans at Raymond James Stadium ("Stadium"). All WiFi Service users (referred to as "you") are governed by the following WiFi Terms and Acceptable Use Policy (the "Terms"). Your use of the WiFi Service represents your agreement to these Terms. If you do not agree with these Terms, do not use the WiFi Service.

Access to WiFi Service

The WiFi Service is complimentary and is offered entirely at the discretion of the Buccaneers. The WiFi Service will provide you with access to the internet via high-speed access points provided at the Stadium. This access is provided via a WiFi network utilizing the 802.11 standard. To access the WiFi Service, you must have a device that is compatible with the specific WiFi equipment available at the Stadium. You are permitted to use the WiFi Service only for your own lawful purposes. You may not in any way distribute, resell, or otherwise provide third parties with access to or use of the WiFi Service.

Security Warning

The insecure nature and ease of connection to public WiFi network hotspots increases the risk that unauthorized parties can access your phone, tablet, laptop, or other device over the WiFi Service network. By using the WiFi Service, you expressly acknowledge and agree that there are significant security, privacy, and confidentiality risks inherent in accessing or transmitting information through the internet, in particular through wireless technology. Your use of the WiFi Service is at your sole risk. You are solely responsible for implementing your own security protections while using the WiFi Service, for the security of your connected device and its contents, and for keeping all of your usernames, passwords, and other security-based information secure and private. We highly discourage you from conducting confidential transactions (such as online banking, credit card transactions, etc.) over the WiFi Service. You agree to hold Buccaneers harmless for the loss of any file, data, or other information, for any computer viruses or other corruption to your device, for any other damage or detrimental effects to your device, and for any unauthorized access to or utilization by any third party of any of your personal, financial, or other sensitive files or information, related in any way to your use of the WiFi Service.

Disclaimer

Your use of the WiFi Service is AS IS and AS AVAILABLE and the Buccaneers cannot and does not make any general or specific warranties regarding the security, availability, performance, or other functionality of the WiFi Service. BUCCANEERS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND RELATED TO THE WIFI SERVICE, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BUCCANEERS MAKES NO WARRANTY THAT THE WIFI SERVICE WILL MEET YOUR REQUIREMENTS, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE, OR CONCERNING THE SECURITY AND SAFETY OF THE SERVICE. BUCCANEERS EXPRESSLY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR YOUR USE OF THE WIFI SERVICE. No advice or information, whether oral or written, obtained by you from Buccaneers or its representatives or through or from the WiFi Service shall create any warranty not expressly stated in these Terms.

Modifications to the WiFi Service / Updates to the Terms

Buccaneers reserves the right to modify, discontinue, temporarily or permanently, at any time, the WiFi Service and these Terms with or without notice. If you do not agree, or do not comply, with any modified Terms, you may not use the WiFi Service. Any changes to these Terms will be posted to www.Buccaneers.com/WiFi or at such other website as the Buccaneers may designate, and you should check that page periodically for updates. Your use of the WiFi Service constitutes your binding acceptance to these Terms as they may be modified.

Technical Requirements/Performance Limitations

The WiFi Service is subject to the availability and the operational limitations of the requisite equipment and associated facilities. Your device must be in close enough proximity to the WiFi Service access points to achieve connectivity with the WiFi Service network. You understand and agree that temporary interruptions of the WiFi Service may occur and that Buccaneers will not be liable for such interruptions. The WiFi Service may be subject to external interference, environmental influences, and other factors beyond Buccaneers' reasonable control, such as network traffic and congestion; performance, configuration, functionality of your device and/or wireless cards; physical obstructions and distance between your device and the WiFi Service network; availability of electric power; collocation failures; transmission and equipment limitations; network failures; scheduled and unscheduled maintenance/repair; and user error. Buccaneers is not responsible for data lost or misdirected, or any other damages or losses, due to these or other foreseeable or unforeseeable factors. Network speed is an estimate and is not an accurate indication of the speed at which your device or the WiFi Service will operate. Actual network speed and other performance will vary. There is no guarantee of your bandwidth on the WiFi Service. The WiFi Service is not suitable for supporting any application that requires continuous, error-free network connectivity or uninterrupted data flow. Buccaneers may implement URL filtering or other content filtering services which block access to certain websites or content while at the Stadium, at its sole discretion. Buccaneers shall not have any responsibility for such content filtering and will not be liable to you or any other party for any acts, omissions, performance, or non-performance related to the content filtering.

Right to Monitor and Manage Network Usage

The Buccaneers utilize automated processes to monitor and scan communications over the WiFi Services network in order to maintain, repair, and provide the WiFi Services network and related services, improve user experience, and improve integrity of user communications. By using the WiFi Service you agree and give consent to Buccaneers to collect, use, and store this information. You also consent to Buccaneers sharing this information with any subcontractors or agents engaged by Buccaneers to provide any support, administration, or other services related to the WiFi Service, to any company or organization to whom Buccaneers transfers its responsibilities to provide the WiFi Service, and to government authorities in the event of suspected or alleged crimes or civil wrong doing. Specifically, but without limitation, Buccaneers and these authorized third parties may use this information for metrics reports and external marketing and analytics reports demonstrating WiFi Service network usage, such as the number of devices connecting to the WiFi Service network, duration of WiFi Service sessions, and WiFi Service bandwidth utilization. These reports contain aggregate and anonymous data. Buccaneers does not automatically collect, use, store, or share with any other party personal information that will allow the recipient to specifically identify you, without your consent. Buccaneers is not responsible for how any third party, including any operator of a website that you access through the WiFi Service, collects or uses your information.

Third Party Materials

Any material downloaded or otherwise obtained through the use of the WiFi Service is done at your own discretion and risk and you will be solely responsible for any damage to your device. Any content accessed through the WiFi Service, unless it is expressly identified as being provided by SMC, is third party content which Buccaneers has no control over and which is not independently authenticated in whole or in part by Buccaneers. You agree that Buccaneers is not responsible in any way for any third-party website content, or the operation of any third-party website accessed via the WiFi Services network.

Compliance with Laws

You may use the WiFi Service only as permitted by applicable federal, state, and local laws, and in a manner consistent with the rights of others. The WiFi Service shall not be used in a manner which would violate any law or infringe any copyright, trademark, trade secret, right of publicity, privacy right, or any other right of any person or entity. The WiFi Service shall not be used for the purpose of accessing, transmitting, or storing material, which is considered obscene, libelous, or defamatory. Illegal acts may subject you to prosecution by local, state, federal, or international authorities. Buccaneers reserves the right to report to, and cooperate with, legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrongdoing.

Indemnity

You agree to indemnify and hold harmless Buccaneers and its respective subsidiaries, affiliates, officers, agents, co-branders, and licensors, and the other partners and employees of each, from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of content you submit, post, transmit, or otherwise make available through the WiFi Service network, your use of the WiFi Service, your violation of these Terms, your violation of any laws or rights of another party, or any use of your device whether or not such usage is authorized by you.

Limitation of Liability

YOU ACKNOWLEDGE AND AGREE THAT THE WIFI SERVICE IS PROVIDED SOLELY FOR YOUR CONVENIENCE AND DOES NOT IMPOSE LIABILITY OF ANY KIND ON THE BUCCANEERS, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOSS OF BUSINESS, BUSINESS INTERRUPTION, LOSS OF DATA, OR OTHER SIMILAR DAMAGES) ARISING OUT OF OR RELATED TO THESE TERMS OR THE WIFI SERVICE; EVEN IF BUCCANEERS IS ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES.

Enforcement

Buccaneers reserves the right to investigate violations of these Terms, including by gathering information from the user and the complaining party, if any, and examining material on Buccaneers' servers and network. If Buccaneers, in its sole discretion, determines that you have violated these Terms, Buccaneers may take any responsive action that it deems appropriate in its sole discretion without prior notification. Such actions include but are not limited to temporary suspension of access to the WiFi Service, reduction of WiFi Service resources, and termination of access to the WiFi Service. Buccaneers is not liable for any such responsive action and these actions are not exclusive. Buccaneers may take any other legal or technical action it deems appropriate.

Choice of Law and Dispute Resolution

FLORIDA LAW GOVERNS THESE WIFI TERMS AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THESE WIFI TERMS, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES, SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS' MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN TAMPA, FLORIDA. THE PREVAILING PARTY IN ALL SUCH ARBITRATIONS SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS' FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW. EACH PARTY WAIVES THE RIGHT TO A COURT OR JURY TRIAL AND ANY RIGHTS TO PARTICIPATE IN ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER. IF HOLDER DOES NOT CONSENT TO THESE TERMS, HOLDER MUST NOT UTILIZE THE WIFI SERVICE.

Field Pass and Credential Terms

This credential is a revocable license issued to you for the designated event ("Event") and may be revoked and admission refused at any time to any person whose conduct is deemed by Buccaneers Team LLC ("Buccaneers") to violate the terms and conditions contained herein, or for any other reason at the sole discretion of the Buccaneers. You acknowledge and agree to comply with all applicable policies of the Buccaneers, including without limitation, any security and conduct policies, and any health screenings (as further detailed below).

ASSUMPTION OF RISK. YOU VOLUNTARILY ASSUME ALL RISKS, HAZARDS, AND DANGERS incident to the use of this credential, including without limitation the risk of contracting a communicable disease or illness, (including exposure to a bacteria, virus, or other pathogen capable of causing a communicable disease or illness), and any other injury risks (including death) associated with being in, at or around Raymond James Stadium or AdventHealth Training Center, each located in Tampa, Florida. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE WHERE PEOPLE ARE PRESENT, INCLUDING THOSE WITH OR WITHOUT MASKS AND ADDITIONAL PERSONAL PROTECTIVE EQUIPMENT ("PPE") OR IMPROPERLY USING MASKS OR PPE. COVID-19 IS AN EXTREMELY CONTAGIOUS VIRUS THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. ACCORDING TO THE CENTERS FOR DISEASE CONTROL AND PREVENTION, SENIOR CITIZENS AND THOSE WITH UNDERLYING MEDICAL CONDITIONS ARE ESPECIALLY VULNERABLE. BY ENTERING RAYMOND JAMES STADIUM, ADVENTHEALTH TRAINING CENTER, AND RELATED STADIUM GROUNDS (INCLUDING, WITHOUT LIMITATION, PARKING FACILITIES AND ENTRY GATES), YOU VOLUNTARILY ASSUME ALL RISKS RELATED TO EXPOSURE TO COVID-19, INCLUDING BUT NOT LIMITED TO EXPOSURE TO CARRIERS OF THE VIRUS WHO DO NOT HAVE SYMPTOMS OF COVID-19 AND/OR YOU TRANSMITTING THE COVID-19 VIRUS TO OTHERS DURING OR AFTER THE EVENT.

RELEASE, WAIVER AND COVENANT NOT TO SUE. YOU HEREBY RELEASE, WAIVE, and COVENANT NOT TO SUE each of the Released Parties (defined below) with respect to any and all claims, including for negligence and/or wrongful death, that you may have (or hereafter accrue), against any of the Released Parties, that relate to any of the risks, hazards and dangers described in the preceding paragraph, including without limitation any and all claims and damages of any kind or character that arise out of or relate in any way to (i) your exposure to COVID-19; (ii) your entry into, or presence within or around, an Event at the Stadium (including all risks related thereto, and including without limitation in parking areas or entry gates) or compliance with any protocols applicable to each Event; (iii) any interaction between you and any personnel of any of the Released Parties present at each Event; (iv) any act or omission on the part of Stadium or any of the Released Parties in connection with monitoring or policing protocols applicable to each Event, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise. TO THE EXTENT THAT YOU, OR PERSONS WHO CLAIM THAT THEY CONTRACTED COVID-19 FROM YOU, FILE A CLAIM, SUIT OR ARBITRATION AGINST ANY OF THE RELEASED PARTIES ARISING FROM OR RELATING TO THESE TERMS OR THE EVENT AT THE STADIUM, YOU HEREBY AGREE TO FULLY INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES AGAINST SUCH CLAIM, SUIT OR ARBITRATION TO THE FULLEST EXTENT PERMITTED BY LAW. IT IS ACKNOWLEDGED AND AGREED THAT THE RELEASED PARTIES ARE USING COMMERCIALLY REASONABLE EFFORTS TO ENSURE AND ENFORCE COMPLIANCE WITH APPLICABLE CDC GUIDELINES AND STATE AND LOCAL LAWS FOR PROTECTION AGAINST COVID-19 ("COVID-19 BEST PRACTICES"), HOWEVER, NOTWITHSTANDING, HOLDER AGREES TO RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FOR ANY FAILURE OF THE RELEASED PARTIES TO ENSURE OR ENFORCE ANY COVID-19 BEST PRACTICES.

As used herein, "Released Parties" means: (i) Buccaneers Team LLC, Buccaneers Stadium LLC, Tampa Sports Authority, RJS Stadium, A Commercial Condominium Association, Hillsborough County, the City of Tampa, NFL Ventures, Inc., NFL Ventures, L.P., the National Football League and its other professional member clubs, and each of their respective direct and indirect affiliates, administrators, designees, licensees, agents, owners, officers, directors, general partners, partners, members, employees, contractors (and all employees of such contractors) and other personnel; (ii) the direct and indirect owners, lessees and sublessees of the Stadium and related stadium grounds (including, without limitation, parking areas and entry gates); (iii) all third parties performing services at the Stadium and related Stadium grounds (including, without limitation, parking areas and entry gates), including but not limited to Legends Hospitality, LLC, Fanatics Retail Group Concessions, LLC, Sentry Event Services, Inc, and Performance Clean, LLC; and (iv) any parents, subsidiaries, affiliated and related companies and officers, directors, owners, members, managers, partners, employers, employees, agents, contractors, sub-contractors, insurers, representatives, successors and/or assigns of each of the foregoing entities and persons, whether past, present or future and whether in their institutional or personal capacities.

You grant irrevocable permission to Buccaneers and its sponsors, licensees, advertisers, broadcasters, designees, partners and agents to use publish, distribute, edit, modify and/or alter your image, likeness, voice, actions and statements in any medium including, without limitation, any audio, video, film, photographs, social media, exhibition, transmission, publication or reproduction of any events at AdventHealth Training Center or Raymond James Stadium for any purpose without further authorization or compensation, and you waive all claims and potential claims relating to such use unless prohibited by law. By accepting this credential, you acknowledge that you have read and are bound by the terms and conditions provided above and incorporated by reference.

ARBITRATION; JURY TRIAL WAIVER; CLASS ACTION WAIVER; CHOICE OF LAW AND TORT CLAIM FORUM SELECTION: FLORIDA LAW, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES, GOVERNS THESE TERMS AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THESE TERMS, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE CLAIMS AND TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES.

EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL CLAIMS IN ANY WAY RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS' MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN TAMPA, FLORIDA.

NOTWITHSTANDING THE FOREGOING, ANY TORT OR TORT-RELATED CLAIM (INCLUDING BUT NOT LIMITED TO NEGLIGENCE CLAIMS AND STATUTORY CLAIMS) IN ANY WAY RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE LITIGATED IN A COURT OF COMPETENT JURISDICTION IN HILLSBOROUGH COUNTY, FLORIDA. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL. FURTHER, EACH PARTY WAIVES THE RIGHT TO A COURT TRIAL WITH RESPECT TO NON-TORT CLAIMS HEREUNDER.

EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY DISPUTE AGAINST ANY OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, WHETHER DURING BINDING ARBITRATION, OR LITIGATION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF COMPETENT JURISDICTION CONSTRUING THIS AGREEMENT TO BE AGAINST PUBLIC POLICY AND ANY RIGHTS TO PARTICIPATE IN, AND AGREES NOT TO PARTICIPATE IN, ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION OR COURT PROCEEDING, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER.

THE PREVAILING PARTY IN ANY PROCEEDING RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM, STADIUM GROUNDS, OR STADIUM PARKING AREAS SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS' FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION OR LITIGATION AS THE CASE MAY BE, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.

This credential (i) grants access to limited areas solely as designated by the Buccaneers; (ii) is non-transferrable; and (iii) must be worn visibly at all times. Unless explicitly granted permission by the Buccaneers, you do not have access to any non-designated areas. Violation of any of these terms may lead to revocation of the credential and/or legal action. Credentials obtained from sources other than an authorized representative of the Buccaneers will not be honored. A replacement fee may be charged if this credential is lost or stolen. Use of this credential constitutes agreement with the terms listed.

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND BUCCANEERS HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IN THE ACTIVITY IF YOU DO NOT SIGN THIS FORM.

You agree that by use of the Credential and entry into Raymond James Stadium or related stadium grounds (including parking facilities and entry gates), it shall be construed that you have read and consented to accept these Terms with the same force and effect as if you signed these Terms, including but not limited to, the form waiving and assuming the risk of inherent risks on behalf of a minor child.

HEALTH PROMISE

Stay-at-home: You agree that you will not attend any Event at AdventHealth Training Center or Raymond James Stadium if any one or more of the following is true on the day of such Event:

  • Within the prior 14 days, you have (or any person in your party or with whom you have close contact has) tested positive for, or been exposed to someone who has tested positive for, COVID-19;
  • Within the prior 48 hours, you have (or any person in your party or with whom you have close contact has) experienced symptoms of COVID-19 (e.g., a fever of 100.4⁰F or higher, cough, shortness of breath or difficulty breathing, chills, repeated shaking, muscle pain/achiness, headache, sore throat, loss of taste or smell, nasal congestion, runny nose, vomiting, diarrhea, fatigue or any other symptoms associated with COVID-19 identified by the CDC);
  • Within the prior 14 days, you have (or any person in your party or with whom you have close contact has) travelled to any state or international territory identified by federal or applicable local governments as being subject to travel or quarantine advisories due to COVID-19.

Health Screening: You agree that you may be required to submit to a health screening before entering Raymond James Stadium, AdventHealth Training Center, and related stadium and training center grounds.

  • Such health screening shall be as determined by the Buccaneers in its sole discretion, and may include, without limitation, an evaluation for COVID-19 symptoms, affirmation of a negative COVID-19 test, and/or confirmation that you have been fully vaccinated for COVID-19.
  • Buccaneers shall have the right to deny admission to anyone who (1) refuses to submit to a health screening, or (2) fails the health screening's conditions for admission to Raymond James Stadium, AdventHealth Training Center, and related stadium and training center grounds, as determined by Buccaneers in its sole discretion.

If any provision of these Terms is determined to be invalid or unenforceable, such provision will be amended to the minimum extent necessary to make such provision enforceable and the remainder of these Terms will not be affected, but will continue to be valid and enforceable to the fullest extent permitted by law.

IF YOU DO NOT CONSENT TO ALL OF THE TERMS IN ALL PARAGRAPHS SET FORTH ABOVE, YOU MUST LEAVE OR NOT ENTER ADVENTHEALTH TRAINING CENTER, RAYMOND JAMES STADIUM, AND RELATED TRAINING CENTER AND STADIUM GROUNDS (INCLUDING, WITHOUT LIMITATION, PARKING AREAS AND ENTRY GATES). BY ENTERING ANY OF THESE AREAS, YOU AGREED TO THESE CREDENTIAL TERMS.

BUCCANEERS SEASON TICKET WAITING LIST TERMS

The Buccaneers Season Ticket Waiting List provides an organized and fair process for fans to have access to Buccaneers season tickets if and when they become available. Currently, we cannot estimate availability or wait times due to our high renewal rates. Please note that placing your name on the Waiting List does not guarantee that you will have access to Buccaneers season tickets.

Signing up for the Waiting List does not obligate you to purchase. At any time prior to purchasing season tickets that become available, you or the Buccaneers may remove your name from the Waiting List and a full refund of your deposit will be issued. Your place on the Waiting List is non-transferable and non-assignable.

To add your name to the Waiting List, you must contact bucssalesteam@buccaneers.nfl.com and submit the required season ticket application and deposit. Your name will not be added to the Waiting List until we receive your application and deposit in full. All deposits will be applied towards your season ticket account balance once you purchase season tickets. We will notify you if Buccaneers season tickets become available. To ensure your name remains on the Waiting List, report any changes to your contact information as they occur. Ticket brokers or ticket resellers are precluded from signing up for the Waiting List. Importantly, if you provide us with any false and/or inaccurate contact information (i.e., name, address, phone number, and /or e-mail address) or fail to properly update such contact information, we reserve the right to remove your name from the Waiting List and retain your deposit.

In the event that the Buccaneers are unable to offer you season tickets for any season, your deposit automatically shall be applied to the Waiting List for the following season. You may remove your name from the Waiting List at any time by contacting bucssalesteam@buccaneers.nfl.com and your deposit will be refunded.

FLORIDA LAW, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES, GOVERNS THESE BUCCANEERS SEASON TICKET WAITING LIST TERMS AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THESE TERMS, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE CLAIMS AND TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES.

EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL CLAIMS IN ANY WAY RELATING TO OR ARISING FROM MY PARTICIPATION IN THE BUCCANEERS SEASON PASS WAITING LIST SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATIORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS' MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN TAMPA, FLORIDA.

NOTWITHSTANDING THE FOREGOING, ANY TORT OR TORT-RELATED CLAIM (INCLUDING BUT NOT LIMITED TO NEGLIGENCE CLAIMS AND STATUTORY CLAIMS) IN ANY WAY RELATING TO OR ARISING FROM MY PARTICIPATION IN THE BUCCANEERS SEASON PASS WAITING LIST SHALL BE LITIGATED IN A COURT OF COMPETENT JURISDICTION IN HILLSBOROUGH COUNTY, FLORIDA. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL. FURTHER, EACH PARTY WAIVES THE RIGHT TO A COURT TRIAL WITH RESPECT TO NON-TORT CLAIMS HEREUNDER.

EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY DISPUTE AGAINST ANY OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, WHETHER DURING BINDING ARBITRATION, OR LITIGATION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF COMPETENT JURISDICTION CONSTRUING THIS AGREEMENT TO BE AGAINST PUBLIC POLICY AND ANY RIGHTS TO PARTICIPATE IN, AND AGREES NOT TO PARTICIPATE IN, ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION OR COURT PROCEEDING, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER.

THE PREVAILING PARTY IN ANY PROCEEDING RELATING TO OR ARISING FROM MY PARTICIPATION IN THE BUCCANEERS SEASON PASS WAITING LIST SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS' FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION OR LITIGATION AS THE CASE MAY BE, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.
